On March 11, collection agency Rapid Recovery Solution responds to a report from NPR News on fake debt collection scams that are going on in Texas. The company describes some of the ways that people can make sure they are talking to a real debt collector and not a fraud.
Andrew Schneider reports the story for NPR, and was himself actually a potential victim of a fake debt collector after he got two phone calls asking for someone named “Byron Landry.” According to the report, “both [callers] threatened legal action or arrest. Neither identified the creditor in whose name they were attempting to collect. Which means both violated federal and Texas state law.”
John Monderine, CEO of the collection agency Rapid Recovery Solution, notes that there are ways to figure out whether or not the person that is contacting you is a real debt collector or not. “As soon as you are contacted by a person claiming to be debt collector, you should immediately look up the Fair Debt Collection Practices Act, which has some clear restrictions on how and when a collector can contact debtors,” urges Monderine.
One of the most common ways that people end up victimized by fake collectors is by having their personal information leaked after they applied for a payday loan online, reports the article. Whether or not they actually get the loan doesn’t make a difference; their information can still end up in the wrong hands. Once they have this information, it is very easy for them to seem credible.
While many of these fake collectors operate out of foreign countries, some are local. One fake debt collector that was scamming people out of money operated out of Houston until 2011. Charges against the company are still pending, but the company allegedly threatened people with legal action. It is important to know that this is illegal; people can’t be put in prison for being in debt.
“Another important thing to do when contacted by a collection agency is look up the company to make sure they are credible,” says Monderine. “Everyone should also keep detailed records of their finances so that they don’t become the victim of a mistake, or of malicious abuse.”
